Summary A constitutional petition is filed against President over political meddling in Sindh.

The petitioner said that the Pak Army should be barred from issuing any statement about the chaotic condition in any province of the country. The petitioner, Shahid Orkzai said that the president had called a meeting of the Sindh cabinet in the President House, which was diametrically contrary to the spirit of the Constitution. He also said that the Constitution did not give priority to limited military action under Article 245 to cope with the chaotic condition in any province; rather declaration of emergency under Article 232 was the sole solution to such turmoil in any province. While throwing light on the Army’s concern over Karachi situation, he said that according to the Constitution, the Army was not authorised to take any action independently without the assistance of the civil administration. The petitioner, making the Secretary Defence as defendant, prayed to the court that the Pak Army be directed to remain within the limitations of the Constitution.
