Lahore High Court’s Rawalpindi bench sought reply from Defence Ministry against withholding retirement notification of Brig Ali Khan and his military trial in Sialkot.Justice Ijaz Ahmed of Rawalpindi bench of Lahore High Court heard the case of Brigadier Ali Khan detained over alleged links with the banned outfit Hizb-ut-Tahrir.In the petition filed in the LHC through his counsel Advocate Inamur Rahim, Brigadier Khan challenged the legality of his court martial because trial should be carried out at the place where the crime is committed.Judge Advocate General Branch’s lawyer Lt. Col. Tahir said that the court is being misled because Brig Ali is not retired yet because his retirement order was stopped by the federal government.On this, defence counsel to stop the retirement order of a military man does not fall under the jurisdiction of federal government.Court must be informed that under which law his retirement was stopped, Inam asked. Brig Ali’s mother-in-law and brother-in-law were allowed to see Brig Ali after 8 months on court orders, he said. He also pleaded the court to order medical checkup of his client.The court sought the reply from the defence ministry and adjourned the hearing of the case till March 7.
