ZAB reference: SC rules out 'adventure', military courts

Summary No room for confusion in the case. There will be no adventure in the country, CJP says.

An 11-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhry has resumed hearing of Presidential reference for revisiting Zulfiqar Ali Bhutto death sentence case.Chief justice Iftikhar Mohammad Chaudhry while hearing the case remarked that more than 300 hundred prisoners are sentenced death penalties, likewise, they can also seek presidential reference.Chief Justice said President cannot favour one side or a party, as he is the constitutional authority, adding that court will see either this case is worth hearing or not.In reply federation’s representative Babar Awan argued that court is constitutionally bound to hear presidential reference.Chief Justice stated that constitution has always been supreme until Supreme Court is functional.He further referred that Liaquat Hussain case abolished jurisdictions of military courts, so there should be no confusion, no adventure will happen this time.
