Summary AAG told Supreme Court (SC) Masood Janjua was killed by Al-Qaeda militants.
A 3-member bench of SC headed by Justice Mian Shakir Ullah Jan took up the case of missing persons for hearing Wednesday.The Additional Attorney General said Amna Masood Janjua, the missing person’s wife, was of the view that Imran Munir had spotted her husband in the cell under the custody of Brig Masood Saeed Sheikh and Col Jahangir.He pointed out that former ISI DG stated before Justice Fazl-ur-Rehman Commission that both Masood Janjua and Faisal Faraz were not Jihadi but they had soft corner for Al-Qaeda. They had brought a laptop for Al-Qaeda leader Al-Misri. When Al-Qaeda men checked them then tracking chip was found therein, he added.Al-Qaeda militants killed both of them on suspicion. If Amna Masood Janjua had any doubt then she should register a case and everything would come to light, he held.The SC directed the AAG to present all the old cases of missing persons before it today and the court would decide which cases should be heard in SC and which cases be transferred to commission.SP (Investigation) Peshawar Muhammad Umar presented investigation report in the court about missing persons. The court expressed grave concern over it and rejected the report.The court maintained that police had miserably failed to discharge its obligations in connection with recovery of missing persons. Court wanted to reach truth. “We are not sitting here for court’s proceedings”.Justice Anwar Zaheer Jamali observed Peshawar police had recorded statement of Abdul Rehman, a missing person during 20 months. There could be some compulsions of police but court had no such thing, he remarked. If police had any compulsion then it should tell the court, he said.Justice Jawad S Khawaja remarked constitution was there in the country and every citizen had right to live as per one’s will under this constitution. Constitution guarantees for the protection of life of every citizen.Justice Anwar Zaheer Jamali said such situation was arising due to irresponsible attitude of police.About Algerian national Abdul Rehman Al-Q Awami, ADG told the court the person in question was not missing and he had telephoned to his wife from Algeria and his wife had confirmed the telephonic call.The court said record of his telephonic call should have been ascertained. If such record is available then it should be presented, court further remarked.Justice Jawad S Khawaja inquired how Imran Munir went abroad when there were cases against them.The DPO Muzaffargarh told the court Mohsin Rashid had been recovered. Abdul Rashid son of the recovered person told the court that his son had been released.The DPO told the court the youth was in question was in the custody of agencies and he had been released.Justice Jawad S Khawaja said order would be issued that not only the treatment be provided to the said youth but compensation be also paid for being kept in illegal custody.KK Agha told the court Imran Munir used to work as spy for India and he was tried in military court.KK Agha told the court commission constituted for recovery of missing persons had become functional and it would hear all the cases of missing persons individually.
