Summary The Supreme Court has said that the Punjab Government can carry on Ashiana Scheme at its own risk.

However, the Auqaf Department should also be given due share out of profit.The court also ordered to stop illegal construction on the alternate land for a tomb. A three-member bench of the SC led by Chief justice Iftikhar Muhammad Chaudhry conducted hearing of the petition filed against Ashiana Housing Scheme.According to the petitioner, the Punjab Government captured the land measuring 672 kanal of Mizar supervised by Auqaf department in exchange of land measuring 2845 kanal which is situated at a barren area 25 miles away.The Punjab government was of the view that it was entitled to capture the land used for public welfare projects.The Chief Justice remarked that if some land existed vacant round the building of the Supreme Court, the government should make it a housing scheme.A gorgeous project does not mean that the land of other people be captured, adding that it was not possible that a powerful and influential person may conceive that every part of land could be captured by force.The court issued a prohibition order against the construction on the land allocated for Mizar. The hearing of case was adjourned indefinitely.
