LHC dismisses stay order against executions

Lahore (Dunya News)— Lahore High Court (LHC) Rawalpindi Bench on Wednesday dismissed the stay order against executions of five terror convicts. The bench has upheld the stay order against executions. The terrorists on death row are housed in Kot Lakpath jail.

Lahore High Court’s Justice Arshad Mehmood Tabassum, approving the appeal by Federal government, dismissed the restraining order. The five terror convicts will be executed in the coming days.

The prisoners’ counsel Advocate Laiq Khan Swati argued that the crimes committed by the terrorists have not been identified. Moreover, the prisoners were not granted the right to appeal.

On the other hand, Deputy Attorney General Sajjad Ilyas Bhatti took a stance that the case against the convicts was registered on December 21, 2013 and the death penalty was announced February 12, 2014.

The appeal against the executions was dismissed on June 10, 2014 and the convicts were granted right to appeal. The appeals have been dismissed by the military courts since they were involved in the murder of seven soldiers deployed at Jehlum-Punjab Bridge.

He requested the court to dismiss the appeal so that the executions can proceed.

The court handed down its verdict after hearing the arguments by the lawyer.

Separately, the petition filed by the Faisalabad Jail Superintendent in the Lahore Anti-Terrorism Court (ATC) maintains that a terrorist named Faiz in 2000 killed a soldier, Tariq Mehmood while another terrorist named Sharif was involved in several terror acts in Nankana Sahib in 2004. The petition urges the court to issue death warrants of both the terrorists as their appeals against the judgement have been rejected.

The court has issued the death warrants of Sharif and Faiz and they can be hanged any time now in the Faisalabad jail.
