SC passes interim order against extra-constitutional steps

ISLAMABAD (Dunya News) – A four-member larger bench led by Chief Justice Nasirul Mulk passed an interim order against any extra-constitutional steps on Friday.

The bench also constituted Justice Jawad S Khawaja, Justice Asif Saeed Khosa, and Justice Musheer Alam.

The plea had been filed by the President Supreme Court Bar Association (SCBA) Kamran Murtaza. The judgment states that 14 judges had already given stay orders against the extra-constitutional steps in the judgment passed on July 31, 2009. If any state institution takes extra-constitutional steps it is violation of the constitution, the court says.

Supreme Court has accepted Kamran Murtaza’s plea for hearing and has issued notices to all the stakeholders including the government.

Earlier during the hearing, the petitioner SCBA Kamran Murtaza said that country’s situation is chaotic and basic human rights are suspended. He therefore forcibly pleaded the court to give stay order against the extra-constitutional steps. He further added that the apex court has also given a judgment regarding this issue.

The protesters are demanding the resignation of the current government, Murtaza said. Justice Nasirul Mulk remarked that the demands shall not concern the court. The case is highly significant; the Attorney General has therefore been issued a notice.

The Supreme Court would resume the hearing of the plea against the extra-constitutional steps on 18 August.
