Summary Plea says Ch Nisar publicly admitted he has knowledge about Mehsud killing.

ISLAMABADJ (Online) - Islamabad High Court has been approached for staying induction of Chaudhry Nisar Ali as interior minister in federal cabinet besides directing the federal government to sack the interior minister.

The petitioner Shahid Orakzai has taken plea in his petition that interior minister has admitted it publicly that he had warned US ambassador in Pakistan against initiating any action with respect to Hakimullah Mehsud.

The court should ask from interior minister when he had given warning to US government and if the federal cabinet was aware of this warning.

The court was requested to obtain confirmation from US ambassador about this warning. The US ambassador has been made respondent through foreign ministry.

The petitioner prayed to court to ask from US ambassador if he had conveyed interior minister message to his government

The question was raised in the petition if the interior minister was entitled to warn any sovereign state which was having diplomatic relations with Pakistan. If the interior minister can decide to make any contact with member countries of UN Security Council, the petitioner contended.

Four constitutional questions have been asked from federation as well in the petition. These questions focus on mutual relationship between Prime Minister and interior minister.

The petitioner said if the constitution allows interior minister to make any direct contact with a foreign country which is not in the knowledge of prime minister. Article 90 of the constitution entitles prime minister to take any direct action in any matter. Therefore, it should be told if prime minister had given any message to US government about the concerned person this year.

He requested the court to declare that the stance pursued by interior minister with US ambassador was not official stance of Pakistan and the disclosure made regarding interior minister conversation with US ambassador constitutes sheer breach of the oath taken by the respective minister under which he had sworn to keep this matter secret.
