SC adjourns hearing of NAB chief's intra-court appeal

Summary SC will resume the hearing of intra-court appeal of NAB chairman on daily basis from April 11.

 

ISLAMABAD (Dunya News) - A five-member bench of the Supreme Court headed by Justice Anwar Zaheer Jamali resumed the hearing of -court appeal of NAB chairman in contempt of court case.


NAB Chairman Fasih Bukhari’s counsel Sardar Latif Khosa submitted details to the court. He maintained the stance before the bench that Arsalan Iftikhar would also have to appear as witness if the NAB chairman would be trialed.


The petitioner’s lawyer said that the court had directed the NAB to probe into the Arsalan Iftikhar case but the son of the Chief Justice had expressed his lack of confidence on the NAB.


Latif Khosa alleged that Justice Jawad S Khawaj had directed NAB chairman to suspend investigation into Arsalan case.
The NAB chief’s counsel said that the contempt of court law did not exist in the country however a court decision was present.


He argued that according to the law, the Chief Justice should have distanced himself from the hearing of the case against NAB chairman. He said that no court can interfere in the investigatory matters of the NAB.


Khosa said that the President had the authority to appoint NAB chief and the correspondence between the President and NAB chief enjoyed legal protection.


Justice Saqib Nisar remarked that he also agreed that the Chief Justice should have distanced himself from hearing the case.


According to law,  the judge who takes notice on contempt of court he shifts the case to other judge. The apex court

 

adjourned the hearing till April 11 due to NAB chief’s appearance in another bench.
