Summary Atizaz Ahsan says PM didnt write a letter to Swiss officials believing President has got immunity.

He further contended that contempt case could not be initiated against the Prime Minister Yousaf Raza Gilani on this ground. The court, on the contrary, said the contempt proceedings against the PM were linked with the issue of immunity. A 7-member bench headed by Justice Nasirul Mulk is hearing the NRO and contempt case.The PM’s attorney Aitzaz Ehsan said the PM didn’t write a letter to the Swiss officials as he believed the President Asif Ali Zardari has the immunity. Hence this act of the PM didn’t tantamount to contempt of the court, he argued. Justice Nasir remarked if Aitzaz was referring to article 148, then case could not go forward until the interpretation of it.Aitzaz said he was not establishing the President’s immunity but rather was defending the constitutional thinking of the prime minister. The court said the question of President’s immunity should have been raised after writing the letter to the Swiss officials.The court said the letter would have to be written to the Swiss officials.
