Summary PHC issues notice to ECP, KP governor for timely elections
PESHAWAR (Dunya News) – The Peshawar High Court on Monday issued a notice to the Election Commission of Pakistan and Khyber Pakhtunkhwa Governor Haji Ghulam Ali regarding timely elections in the province while responding to the petition of Pakistan Tehreek-e-Insaf (PTI).
Justice Ishtiaq Ibrahim and Justice Attique Shah heard the case while PTI leaders Shaukat Yousafzai, Shibli Faraz, and Kamran Bangash were present in the court.
The PTI’s lawyer said the ECP had written a letter to the governor and constitutionally, the governor was bound to give the date of the elections because elections needed to be held within 90 days of the assembly’s dissolution.
The court raised a question: What would happen if the governor failed to give the date of the elections?
PTI’s lawyer responded that the governor said that the law and order situation needed to be taken into account before the announcement of the date of the elections while mentioning the schedule for the by-polls had been issued.
Later, the court postponed the date of the hearing till February 14.
