Summary Expert says that establishment of new provinces is not possible due to constitutional complexities.
New province cannot be established without 2/3 majority of the provincial assembly which is going to be divided.Constitutional expert are of the view that new provinces seem to be mandatory to the verbal extent but it is not an easy to face the constitutional complexities.According to Section 239 of the Constitution, 2/3 majority of the National Assembly and the Senate was inevitable to get the bill of constitutional amendment passed.But at the same time, Section 4 of the same article says that a bill seeking further demarcation of any province should be passed by the assembly of the province which is going to be divided.Experts are also of the opinion that requisitions and referendums submitted in the provincial assembly for the establishment of new province have no constitutional status; it is just possible through constitutional amendment.They are also of the view that importance of the new province from administrative point of view cannot be denied; but so far as the current situation is concerned, it is nothing but securing political points regardless of ground realities.
