Summary The SHC said that trial court would decide to transfer the Sarfarz Shah case to sessions court.

The petition filed by accused party was rejected. During hearing, defense lawyer (r) Justice Mahmood Alam Rizwi argued against the hearing of said case in the Anti-Terrorism Court. He said that he was not defending the accused but it was reality that it was not an act of terrorism. The accused party, in the very beginning of the case, tried to linger on the case by procedural tactics but they had to face defeat at every step. Later, they raised that matter in the SHC in order to have special relief but here too they met with failure.SHC’s Justice Gulzar Ahmad while addressing the defense lawyer said, “Would you like we announce judgment on evidence and create complicated issues for us. Hearing of evidence is the job of the trial court; we have nothing to do with it.”
