Summary SC orders the government to issue a notification for the appointment of judges in 14 days.
A detailed verdict of a case against the parliamentary committee for judges’ appointment has been issued on Monday. The Supreme Court said that the court can review the administrative decisions and ordered the government to issue notification for the appointment of 6 judges rejected by the parliamentary committee within 14 days.The detailed verdict was written by Justice Shahid Siddiqi and Justice Jawwad S. Khawaja wrote an additional note in Urdu in the verdict. It is said in the court verdict that the court can review the decisions of the parliamentary committee because it’s members were not directly elected by the Houses.According to the detailed verdict, the parliamentary committee can not claim immunity against the court review on it’s decisions and court cannot ignore its constitutional duty to scrutinize the decisions. The verdict said that judges had been appointed covertly in the past and the parliamentary committee can not reject the appointment of any judge without any solid reason.It is said in the verdict that judicial commission’s decision was not the individual decision of the chief justice and the committee didn’t have authority to oppose the decision of the commission.According to the detailed verdict, only judicial commission can judge the eligibility of the candidates for appointment in the SC but the committee can only review the documents of the judges.
