Summary The Supreme Court judge Justice Syed Zahid Hussain has appealed for retirement before attaining the age of superannuation. He was non-functional since the verdict came against the PCO judges.
While a four-judge SC bench has initiated contempt trial against seven sitting but non-functional judges including Syed Zahid Hussain, and has also suspended to issue any order to all the judges.On November 3, 2007, Chief of the Army Staff had declared emergency and issued a Provisional Constitutional Order (PCO). A seven-member panel of the Supreme Court headed by Chief Justice Chief Justice Iftikhar Muhammad Chaudhry and consisting of Justice Rana Bhagwandas, Justice Javed Iqbal, Justice Mian Shakirullah Jan, Justice Nasir-ul-Mulk, Justice Raja Muhammad Fayyaz Ahmad, and Justice Ghulam Rabbani, issued an order declaring the declaration of emergency as null and void, and prohibited all judges to take oath under the PCO.Justice Syed Zahid Hussain took oath under the Provisional Constitutional Order 2007 as a sitting judge of the Lahore High Court.
