Summary Peshawar High Courts non-functional judge Justice Jahanzaib Raheem, rejecting the orders of his dismissal, called the 4-member bench of the Supreme Court to appear in his court. The SC bench is hearing the case of PCO judges.
PHC Justice Jahanzaib, who took oath under PCO, has sent a 7-page notice of 11 points in which it is maintained that only President has authority of his appointment or dismissal and he will only follow the orders of the President. It is maintained in the notice quoting different legal clauses that his dismissal is illegal and the President should send reference against the Chief Justice of Pakistan. In the show-cause notice, he has called Justice Shahid Siddiqi, Justice Javed S. Khawaja, Justice Khilji Arif Hussain and Justice Tariq Pervaiz to appear in his court in the Peshawar High Court on February 21, 2011. Earlier, the SC bench ordered non-functional judge of PHC Jahanzaib Raheem to appear in on February 22.
