Justice Faisal Arab assured to take decision on the basis of majority whereas one judge has added a note of dissent by denying the decision.

Court has adjourned the case hearing till December 9 and directed the Federation to re submit the statements of former prime minister Shaukat Aziz, former law minister Zahid Hamid and Justice Abdul Hameed Dogar.

Earlier, special court reserved its decision on former military ruler Pervez Musharraf s plea to investigate all those former civilian and military leaders who were involved in imposing the emergency in 2007.

A three-member bench of the special court headed by Justice Faisal Arab heard the case.

During case proceedings, Musharraf’s lawyer Farogh Naseem completed his arguments, asking the court to hold a joint trial of all those involved in imposing the emergency.

He said that imposing emergency was a collective action taken in consultation with then civil and military leaders, including then Prime Minister Shaukat Aziz, cabinet members and corp commanders of the former army chief.

"No single person can be held responsible for the imposition of emergency. It is against law," he said.
Meanwhile, the court reserved its decision on the plea till November 21.
