Summary SC justice says government will have to account for the missing persons.
ISLAMABAD (Dunsy News) - Justice Saqib Nisar has remarked missing persons matter will not be resolved by hearing the cases in court.
“We want solid solution to the matter no matter if investigation is conducted afresh. Missing persons will have to be recovered, he remarked.
“The intelligence agencies have never spoken truth in missing persons’ cases. As to why police don’t lay hands on the responsible persons, Justice Ejaz Afzal remarked.
Police performance is a question mark. Court has to see every case on merit. The situation here is this that the police do not find credible evidence. It was duty of public prosecutor to do his own job. Our worries go two fold during the hearing of the cases of missing persons.
How can we issue orders against the accused Arshid without the any application seeking cancellation of his bail. There are certain limitations for us.
A two-member bench of Supreme Court (SC) headed by Justice Saqib Nisar took up missing persons’ case for hearing Tuesday.
The court ordered that challan be presented as soon as possible against the police officer Arshid allegedly involved in enforced disappearance of Khair ur Rehman. The court also directed the subordinate court to complete the trial and give decision soon.
The court also ordered that special security be provided to the father of missing youth and he would not be harassed. The court warned if he is harassed then stern action will be initiated against the senior officers.
Father of the missing person slapped his own face before the court and prayed that police be ordered to shoot him then and there. Father of missing youth wept bitterly.
During the hearing Assistant Advocate General (AAG) Khyber Pakhtunkhwa (KP) told the court the accused Arshid has been granted bail by Peshawar High Court and no solid evidence against him is available. Therefore, he will stand acquitted. Only statement from sister of missing youth who is eye witness is there against him.
Justice Saqib Nisar inquired from him if they can be included in the investigation again. Find out some solution. Missing person should be recovered at any cost.
AAG told the court challan has been presented in the court against the accused police officer Arshid. The police have done whatever it was to do. The remaining job is to be done by the court.
The SC while adjourning the hearing of the case for indefinite period ordered the subordinate court to complete the trial as soon as possible and give decision.
During the hearing of the case Amna Masood Janjua said Arshid be summoned in the court and he be asked in this regard.
The court remarked how he can be summoned as he has been granted bail. He will not speak the truth here as well.
The court also adjourned the hearing of cases of other missing persons on the request of Tariq Khokhar.
