Summary Chief Justice of Pakistan has asked Election Commission to avoid disqualifying candidates.
ISLAMABAD (Dunya News):-The Supreme Court has admitted the petition filed by Dr Mubashar Hassan regarding fair elections.
Three-member bench headed by the Chief Justice Iftikhar Muhammad Chaudhry conducted hearing of the case and while passing his remarks during preliminary argumentation said that actual motif behind the petition is real implementation on Article 62 and 63 of the constitution. But the court should be guided what are prerequisites for fair elections as the court is not authorized to make law in this regard.
The Chief Justice said that the court doesn’t know about complaints raised by the voters against candidates.
He said that the apex court has issued special verdicts in dual nationality case which is enough for our stance.
“So far as the condition of degree for contesting election is concerned, it was indispensable in the past but not at present. The candidates should be avoided to be disqualified without sound reason; rather they should be given prestige” said Chief Justice.
He made it clear the Election Commission should make arrangements for fair polls or be ready to face the court.
Mubashir Hassan’s lawyer, Azher Siddique, was of the view that the Election Commission was telling lies regarding verification of degrees.
